ATV Riding Laws- South Dakota

South Dakota provides a series of ATV regulations for operation in its state parks. These laws apply to both in-state and out-of-state riders that enter public parks for trail riding.

Public Property Regulations

To operate an all-terrain vehicle in a state park, a rider must be at least 14 years old or older and have a valid driver’s license for operation of a motor vehicle. Both a South Dakota and an out-of-state license is valid. In addition, the ATV must be licensed whether it be in the state or with another region.

All riders must have proof of insurance and be able to provide it to the proper officials if necessary. The operation of an all-terrain vehicle can only occur on park roadways within the state parks or in a recreation site that has been designated. It is also acceptable to operate these machines in state off-highway vehicle areas as specified.

South Dakota prohibits the use of these recreational machines on paved or unpaved trail routes and on the shorelines of the beaches. Drivers are required to follow all traffic rules as if they were driving a car. It also prohibits the use of any ATV on a highway unless they are used to cross a roadway.

Operating an ATV in a ditch is allowed as long as the rider is over 12 years of age and operation occurs at the outer edge of the highway. This is prohibited on interstate highways.

The Department of Game, Fish, and Parks prohibits ATV operation on its land, including ditches along the highways of its property whether they own, lease or control the land. It does allow operation on designated trails or marked off-road vehicle areas.

These laws provide exemptions for those that use their ATV to traverse from a field or pasture or use it for farm or ranch work.

Driver Safety

Riders of these ATVs must wear eye protection at all time when driving or riding as a passenger unless there is a windshield on the machine that provides protection. Helmets are necessary for all users under the age of 18 in the park and on public roadways.

Carrying a firearm is prohibited when riding or driving an ATV with the exception of it being unloaded and carried in a case that completely encloses the weapon. This law doesn’t apply to those that have a concealed carry permit. Violating this regulation could result in a Class 2 misdemeanor.

Equipment Requirements

All-terrain vehicles must be outfitted with a horn and have mirrors for visibility. They must also include a headlight and proper braking system that is illuminated with a brake light. A license plate is required on the machine as well.
